AMERICAN FACTORING LAW TREATISE CITED TO NEW YORK STATE FINANCIAL REGULATORS

David B. Tatge, PLLC is pleased to announce that the 850 page treatise AMERICAN FACTORING LAW (Bloomberg/BNA, 2009, with 2017 Cum. Supp.), for which its principal, David B. Tatge, was lead author, together with his co-authors David Flaxman, Jeremy B. Tatge and Robert Franklin, was cited by the American Factoring Association (AFA) in its December 17, 2021 comment letter to the General Counsel of the New York State Department of Financial Services, with respect to proposed rules and disclosure requirements for certain providers of commercial financing, implementing S 5470B (23 NYCRR 600).

Over the years, AMERICAN FACTORING LAW has been cited by judges in both reported and unreported federal bankruptcy court decisions, as well as in motions and briefs submitted by various parties to federal and state courts sitting in California, Connecticut, Florida, Indiana, New York, Ohio, Puerto Rico and Virginia. AFL has also been cited by various third persons in testimony before the Committee for Small Business of the United States House of Representatives and in comments submitted to state regulators from the California Department of Business Oversight.
