Drafting Your Factoring Agreement to Help Achieve a “True Sale”

David Tatge presented "Drafting Your Factoring Agreement to Help Achieve a 'True Sale'" at a webinar hosted by the International Factoring Association, www.factoring.org.

One of the most heavily litigated issues in factoring today is whether or not a particular factoring agreement will be respected by the courts as a "true sale" of account from the client to its factor, or instead be re-characterized as a disguised financing (secured loan) by the factor to its client, now treated as a borrower.
